The point of this assessment is to demonstrate your understanding of the concepts derived from the set readings, the lectures, the tutorials and the multimedia of this Unit.

You must answer each question below by citing at least one reading to explain your answer. You may also cite the multimedia provided on iLearn. Extra research is not required. Set out your answers in 3 numbered paragraphs as you answer the 3 questions below.

Each question is worth the same number of marks. Note that Turnitin provides the marker with a word count. There is no leeway to exceed the word count, and if you

Do so you will lose marks.

Footnotes and bibliography are not included in the word count. Identify three different

Current issues that have been reported in the Australian media since 1 January 2016.

These issues must in some way be related to criminal or anti‐social behaviour, whether

Involving individuals, corporations, organisations or the government.

The issue may have already been addressed by the justice system, or not.

You must cite your media sources in your answers to the questions below. A single event does not, in itself, constitute an issue, although the media source you cite might

Report on a single event. For example, a single murder is not an issue, although a pattern of similar deaths might be.

Note: I will reply to emails which are seeking only to check if the issues chosen are valid. I will not reply to emails seeking to check answers or drafts generally.

  1. In relation to your first issue:

a) Briefly describe the issue. One or two sentences is adequate.

b) Explain where the public interest lies with this issue. Is there more than one valid public interest here?

c) Explain how policy and/or law-makers could devise a policy and/or legal response to this issue that represents the public interest.

If you identify more than one valid public interest, then explain how a policy and/or legal response might reconcile or choose between those interests.

(If a policy and/or legal response to this issue already exists, you may instead discuss how policy or law makers appear to have represented the public interest in their response.)

  1. In relation to your second issue:

a) Briefly describe the issue. One or two sentences is adequate.

b) Explain why responsive regulation could be effective in resolving this issue, and state who (as in, what type of body/organisation) should regulate this issue.

c) Create a responsive regulation pyramid of sanctions to be applied to this issue. Explain in detail the various regulations within your pyramid, identifying which are restorative and which are punitive/retributive. (If you are unable to format your text inside an actual pyramid shape you will not be penalised.

Simply make the levels clear using sub–‐headings.)

  1. In relation to your third issue:

a) Briefly describe the issue. One or two sentences is adequate.

b) Explain why and how the concept of restorative justice, including re-integrative shaming, could be applied to resolve this issue. Address any limitations of restorative justice that may be relevant.
