Criminal Law: Caesar’s Case

On the 14th February 2017, Caesar Lo was celebrating Valentine’s Day with his long term girlfriend, Cleopatra Chew by having a romantic candle lit dinner at the Verendah restaurant in Repulse Bay, Hong Kong. They had both consumed some champagne and were lovingly gazing into each other’s eyes.

To make the evening complete and memorable, At the restaurant, Caesar went down on one knee holding in his hand a red rose and a ring to propose marriage to Cleopatra. As he was doing this, another male diner, Brutus Lo who was extremely drunk, sitting laughed at Caesar saying he “was stupid” and made vulgar, abusive and humiliating remarks about Cleopatra.

At first, Caesar ignored him but Brutus continued with his demeaning remarks very loudly. He said that Cleopatra looked like a “hooker” who would be interested in a man for his money only. Caesar immediately went up to Brutus and told him to stop making such remarks. Brutus ignored him and continued making further abusive remarks. He said that Cleopatra looked like a “cheap Wanchai chicken who must have slept with over 1000 and she probably was suffering from some sexual disease”. He further remarked that Caesar could never satisfy Cleopatra as her sexual appetite must be “insatiable”. He shouted out to Caesar to “dump her”. Caesar became very angry at Brutus. He immediately picked up a knife from the dining table and stabbed Brutus in the stomach.

Brutus fell to the ground. A lot of blood gushed out of his wound. He was taken to the San In Ton Hospital and died in hospital the next day from his injuries.

Advise Caesar as to his criminal liability in the law of homicide, if any.
