Legislation and Childhood

There are three components to this assignment. Please read through these and ensure that all parts are answered fully.

In part A, you will describe and analyse the process of making new laws and consider the issues relating to the discharge of new legislation. Here you will review the process by which a recent Bill has reached Stage Three of the Bill making process; namely the Child Poverty (Scotland) Bill as listed at the Scottish Parliament link below:

In Part B you are required to identify current influences on legislation and demonstrate an understanding of how societal opinion affects views of Morality and justice. This section will be related to the current issue of Child Poverty and will allow you to delve deeper into this issue in relation to the information that has been analysed within Part A.

In part C, you are asked to contrast the legal differences between:

1. Children in natural family settings and substitute family settings

Rights, responsibilities and duties will be key themes here. 

You are required to analyse legislation relating to these groups of children and discuss how this relates to the provision and regulation of services in the care sector. 

The aim of this section is to demonstrate your understanding of how a range of current Scottish legislation impacts on the issues of Child Poverty whilst analysing the impact that societal opinion has on developing views of morality and justice. 

There are many sources, which will be relevant to your research including information from Non-Government Organisations such as Together Scotland and the Child Poverty Action Group. You must also ensure that you use relevant journal articles and further academic reading to support your work. 

Part C

Firstly you are required to discuss the legal differences between children in natural families and children in substitute families and the discussion should include a consideration of rights, responsibilities and duties of relevant individuals or agencies.

You must then provide an analysis od current legislation relating to these groups of children and discuss how this relates to the provision and regulation of services in the care sector.
